The state's Department of Agriculture conducts yearly inspections of food-serving establishments to ensure public safety and safe food-handling practices. Schools are inspected twice per year, according to the Bureau of Food Safety and Laboratories.

Whether an establishment is considered compliant or non-compliant is the discretion of the inspector. There are, however, several violations for which inspectors should automatically consider establishments non-compliant. Called "critical violations," they include food temperature issues, issues with chemicals and how they're handled, and employee hygiene.

Depending on the severity of the situation, inspectors and their supervisors could file citations or close an establishment.

Below is a list of establishments listed for inspections conducted March 6-12.


China One, 840 North US Route 15, Dillsburg.

Action: Issued violations include chemicals being stored in storage area on shelving above food, utensils, and equipment, a food employee not following proper handwashing procedure, a food employee not wearing proper hair restraints, food in freezer stored open with no covering, wet wiping cloths in kitchen area not being store in sanitizer solution, food stored directly on the floor rather than 6 inches above floor as required, food thawing at room temperature in kitchen (which is not an approved thawing method), and no soap available at the hand sink.


Comment: An English-speaking manager or owner was not available.

Giant Food Store, 2415 E. Market St., York.

Action: Violations included a container of glass cleaner stored above or on the same shelf with food-related items, a food employee not following proper handwashing procedures in the salad bar area because hot water was turned off, deli utensils stored in sanitizer water, ciabatta bread open and not protected from overhead contamination, frozen foods not maintained in a frozen state in the meat and seafood chest freezers due to overfilling, a food thermometer not scaled properly in the deli, three knives in the salad bar knife rack that were not clean, hand sink in the bakery area blocked by a cart and not accessible at all times for employee use, salad bar hand sink leaking water, paper towel dispenser empty at the hand sink in the salad bar area, floor drains not clean in the bakery, meat room, and salad bar, and walk-in milk cooler fan covers with an accumulation of static dust.

Comment: Chris Brand, Giant's community relations manager, said in an email that all issues were corrected immediately.

"Food safety is our number one priority at Giant. We maintain some of the highest standards of performance in the business in order to fulfill our commitment to customers," he said.

"Following the health inspection, our quality assurance group worked with closely with store personnel and food safety protocols were reviewed. Additional training was conducted by our store management team to prevent further violations. We have also asked for a re-inspection of the store."

Roma's Pizza & Restaurant, 2 E. Main St., Dallastown.

Action: Violations included Comet cleanser with bleach being stored on the same shelf with pasta and vegetable oil, employee drinking from an uncovered beverage cup in a food preparation area, two male employees involved in food preparation with full beards and not wearing a beard restraint, marinara sauce discarded because it was being held on the grill with an internal temperature of 128 degrees rather than the 135 degrees or higher required, non-food-grade waste receptacles being used to store prepared pasta and pizza sauce inside the walk-in refrigerator, cardboard used to line food storage shelving in the kitchen, black mold-like spotting inside bulk ice machine, and an accumulation of static dust on the exhaust hood filters above the grill and deep fat fryers. 

Comment: Owner Josephine Shaffer said the shop has been in business for 17 years and safety of customers is a priority.

All violations were either corrected on spot of the inspection or within a day, she said.

The sauce ws placed on the grill because the stove was being cleaned, but the grill didn't heat the sauce enough, she said.

Male employees are now clean shaven, she said.

"We're so picky about it, the place is like spotless," she said. "My husband is a clean freak and day in and day out we tell them about the cups (for employee beverages). We address the problems every single day but as soon as you leave for a little bit, things like this happen."
