The state's Department of Agriculture conducts yearly inspections of food-serving establishments to ensure public safety and safe food-handling practices. Schools are inspected twice per year, according to the Bureau of Food Safety and Laboratories.
Whether an establishment is considered compliant or non-compliant is the discretion of the inspector. There are, however, several violations for which inspectors should automatically consider establishments non-compliant. Called "critical violations," they include food temperature issues, issues with chemicals and how they're handled, and employee hygiene.
Depending on the severity of the situation, inspectors and their supervisors could file citations or close an establishment.
Below is a list of establishments listed as compliant and out-of-compliance for inspections conducted Oct. 22-Nov. 7.
OUT OF COMPLIANCE
Dunkin Donuts/Baskin Robbins, 2175 S. Queen St., York. Buying jewelry in York County could help a child go to school in Guatemala.Action: Violations included gasoline stored with food-service equipment; no hot water; an employee's open beverage container stored in the food-preparation area; a food employee eating or testing food in the serving area; most food handlers were not wearing hair restraints; broken glass plate and food debris in microwave; food residue on a milkshake machine; accumulation of static dust on walk-in fan covers; dumpster lids were not closed, and trash was spilling to the ground.
Comment: A manager said all violations were corrected.
Lion's Den Café, 1031 Edgecomb Ave., York.
Action: Violations included a tray of warm or freshly baked cookies stored on mop sink; improper use of time in lieu of temperature as a control for potentially hazardous foods; a required consumer advisory about foods cooked to customer request was not in a location visible to the consumer; improper temperatures in dishwasher; food debris on heated-cheese dispenser; static dust on light panels and short-order preparation area; dish racks stored directly above grease trap; an electric food slicer was stored under waste water drain lines.
Comment: Many violations were corrected on the spot, according to a state inspection report. A manager could not be reached for additional comment.
Lyndon Diner, 1353 Kenneth Road, York.
Action: Violations included severely dented, swolled, distressed canned items; raw animal food stored above ready-to-eat food in walk-in cooler; clumps in breading for potentially hazardous foods were not being sifted every four hours; grease on small mixer; wet wiping cloths with no sanitizer on them; food slicer contained food residue; underside of shelf above steam table was not clean to sight and touch; boxes of single-use to-go items were stored on the basement floor; handwash sink in the back area was blocked by stacks of buckets and not accessible at all times for employee use; outside dumpster lid was not closed; food facility operator failed to post an original, valid food employee certification in a location conspicuous to the consumer.
Comment: A manager did not return a call seeking comment.

Action: Violations included the person in charge walked in the store and spit into the sink at the beverage counter; bedding and personal care products in the food facility, indicating use of the food facility as living or sleeping quarters; food facility operator failed to post an original, valid food employee certification in a location conspicuous to the consumer.
Comment: A supervisor said the violations were corrected.
