The state Department of Agriculture conducts annual inspections of food-serving businesses to ensure public safety and safe food-handling practices. Schools are inspected twice per year, according to the Bureau of Food Safety and Laboratories.

Whether an establishment is considered compliant or non-compliant is the discretion of the inspector. There are, however, several violations for which inspectors should automatically consider establishments non-compliant. Called "critical violations," they include food temperature issues, issues with chemicals and how they're handled, and employee hygiene.

Depending on the severity of the situation, inspectors and their supervisors could file citations or close an establishment.

Below is a list of establishments listed as out-of-compliance for inspections conducted April 7 - April 11.


George's B-Street Subs, 429 Baltimore St., Hanover

Action: Violations included direct access from customer restrooms to food preparation and food storage areas; raw, shelled eggs stored above ready-to-eat foods in two refrigerators; a bottle of lotion on the same shelf as food storage containers; food utensils stored in a container of water not maintained at 135 degrees; tongs stored on the hood fire suppression pipes; rusty shelves in refrigerator; damaged wall in a a storage room; boxes of single-use containers stored directly on the floor; mop water being disposed of outside on the ground; no handwash sink in the food preparation/warewashing area; door in the rear area of the building does not latch properly or protect against the entry of insects, rodents and other animals; lights are not completely shielded or shatterproof; accumulation of static dust on refrigerator fans; accumulation of food debris on a non-food contact surface; accumulation of food residue on upper-inside of floor mixer; a cloth towel being used in the process of making/oiling dough.

Comment: A manager did not return a call seeking comment.

Giambanco Brothers, 500 Hellam St., Wrightsville

Action: Violations included an employee cleaning and refilling the deep fat fryers with a common cloth terry towel over their shoulder, and using that towel to wipe their face, mouth and hands; an employee's open beverage container next to condiment packages; a food employee not using a beard cover; personal care items stored in food preparation areas; improper thawing; cracked, chipped and split plastic lids being used to cover refrigerated pizza dough; leaking liquid dripping into a pan inside the reach-in refrigerator; wiping cloths being stored inside a bucket with detergent and water, rather than sanitizing solution; a Food Employee Certification that expired July 19, 2012.

Comment: Manager Susan Buccilla said some violations were corrected and some are being disputed. Video footage shows some of the violations didn't happen as the inspector reported, she said.

MA & PA Pizza, 5850 Delta Road, Delta

Action: Violations included use of plastic cups and bowls as scoops for food; boxes of food stored directly on the floor in the walk-in freezer; old food and dirt residue on potato cutter; encrusted food debris on pizza-prep refrigerator handles; old dirt debris and deceased insects on bottom shelf in Coca-Cola display case; dirt, debris and dead insects in sliding door grooves of dessert display; single-use tableware not stored with handles up; large amount of condensation inside the walk-in freezer; plumbing system not maintained in good repair; wall around dishwashing area made of sheet rock and is cracked, rough and hard to clean; light shield broken above cooks line; a hole in the ceiling wall above the clean dish rack; black soot and grease dripping from suppression lines; a certified food employee was not available during all hours of operation.

Comment: Manager Mark Smith said all violations have been corrected and the restaurant is ready for its follow-up inspection.
