A York City man landed on his head after falling off his second-floor balcony during a domestic dispute early Tuesday morning, according to police.

Moises Muniz, 43, remains in satisfactory condition in York Hospital, a hospital spokeswoman said Thursday morning.

York City Police said Muniz also broke his leg during the fall.

His roommate, 35-year-old Tony Leon Russell of 108 W. Jackson St., remains free on $10,000 unsecured bail, charged with simple assault during a mutual fight.

Argument: The two men were arguing about 12:30 a.m., apparently because Muniz had been drinking and Russell didn't want to let him inside their home drunk, police said.

During the argument, Muniz picked up a plastic shovel and began banging on their second-floor door, causing Russell to open the door and grab the shovel, police said.

The men tussled over the shovel and began shoving each other, police said; at some point, Muniz fell off their balcony and landed on his head.

Despite landing on his head, Muniz also broke his right upper leg, police said.

A witness to the fall reported seeing Muniz and Russell fighting over the shovel, then saw Muniz fall over the railing, according to police.
