WILKES-BARRE, Pa.—A judge has dismissed a lawsuit filed by Luzerne County's former chief public defender on the grounds that he doesn't have authority to sue because he's no longer in the job.

Al Flora Jr. filed suit in Luzerne County Court in 2012, claiming his office was too underfunded and understaffed to meet its constitutional mandate to provide legal counsel to poor defendants.

He said he was forced to limit the cases his office would accept, leaving more than 300 defendants without an attorney as the county failed to provide an alternate source of legal representation.

Flora was fired in April and in a separate lawsuit claims his termination was a retaliatory move by county officials.

Flora's attorney Kim Borland said they're disappointed in Tuesday's ruling and are reviewing their options.
